Testamentary Wills, Living Wills, Powers of Attorney, and
Declarations of Guardianship

Over 90% of Americans do not have documents necessary to express their last wishes! Consequently, this large majority of folks leave those decisions in the hands of their relatives, and the government. While thinking about our demise may be uncomfortable, it is necessary to do in order to relieve our loved ones of trying to make those decisions for us that we should have made for ourselves. A Living Will and a Medical Power of Attorney can avoid a "Terry Schiavo" situation. A Testamentary Will allows us to dispose of our property, in accordance with our wishes, at the time of our passing on from this life. A General Durable Power of Attorney can be used to allow a trusted person to manage our affairs should we become disabled. Finally, a Declaration of Guardian allows us to choose who will (and/or who will not!) be appointed as our Guardian, should that need arise in the future. We have handouts for our clients that further explain each of these legal instruments.

David Heiman: In His Own Words
I was licensed to practice law by the Supreme Court of Texas on November 3, 1989. During my first 2 years of practice, I trained extensively as a Plaintiff's Personal Injury Lawyer in a high volume law firm. Since December 1991, I have been in my own law firm, and have handled cases under the Texas Family Code (in addition to my personal injury practice), involving divorce, child custody, modification, adoption, parental rights termination, and child support. I have successfully handled appellate cases and mandamus cases in the Fort Worth, Texas, Court of Appeals, and in the Supreme Court of Texas.
